Fique atento \u00e0s mudan\u00e7as de pontua\u00e7\u00e3o para cada per\u00edodo de promo\u00e7\u00e3o.<\/p>\n<h4 style=\"text-align: center;\"><strong>DECRETO N\u00ba 37.770, DE 14 DE NOVEMBRO DE 2016(*)<\/strong><\/h4>\n<p style=\"text-align: justify;\"><strong>Publicado no DODF n\u00ba 215, de 16\/11\/2016. Republicado no DODF n\u00ba 216, de 17\/11\/2016. <\/strong><strong>P\u00e1gs. 1 a 10.<\/strong><\/p>\n<p style=\"text-align: justify;\"><em>Regulamenta a promo\u00e7\u00e3o funcional dos servidores da Administra\u00e7\u00e3o Direta, Aut\u00e1rquica e Fundacional do Distrito<\/em><a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=840&amp;amp;txtAno=2011&amp;amp;txtTipo=4&amp;amp;txtParte\"><em> Federal de que trata o artigo 56, da <\/em><em>Lei Complementar n\u00ba 840\/<\/em> <em>2011<\/em><em>.<\/em><\/a><\/p>\n<p style=\"text-align: justify;\"><strong>O GOVERNADOR DO DISTRITO FEDERAL<\/strong>, no uso das atribui\u00e7\u00f5es que lhe s\u00e3o conferidas pelo art. 100, incisos VII e XXVI, da <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=0&amp;amp;txtAno=0&amp;amp;txtTipo=290&amp;amp;txtParte\">Lei Org\u00e2nica do Distrito Federal<\/a>, <strong>DECRETA<\/strong>:<\/p>\n<p style=\"text-align: justify;\">Art. 1\u00b0 O instituto da promo\u00e7\u00e3o funcional, aplic\u00e1vel aos servidores pertencentes \u00e0s carreiras da Administra\u00e7\u00e3o Direta, Aut\u00e1rquica e Fundacional do Distrito Federal fica regulamentado por meio das disposi\u00e7\u00f5es constantes neste Decreto.<\/p>\n<p style=\"text-align: justify;\">Par\u00e1grafo \u00fanico. Excetua-se do disposto no caput as carreiras de Assist\u00eancia \u00e0 Educa\u00e7\u00e3o, Assist\u00eancia Judici\u00e1ria, Bombeiro Militar, Defensor P\u00fablico do Distrito Federal, Delegado de Pol\u00edcia, Magist\u00e9rio P\u00fablico, M\u00fasico, Pol\u00edcia Civil, Pol\u00edcia Militar e Procurador do Distrito Federal.<\/p>\n<h4 style=\"text-align: justify;\">DA PROMO\u00c7\u00c3O FUNCIONAL<\/h4>\n<p style=\"text-align: justify;\">Art. 2\u00b0 A promo\u00e7\u00e3o funcional \u00e9 a passagem do \u00faltimo padr\u00e3o da classe em que o servidor se encontra para o primeiro padr\u00e3o da classe imediatamente superior, no mesmo cargo.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1\u00ba S\u00e3o tr\u00eas os requisitos para a concess\u00e3o da promo\u00e7\u00e3o funcional: I &#8211; cumprimento com \u00eaxito do per\u00edodo de est\u00e1gio probat\u00f3rio;<\/li>\n<li>&#8211; cumprimento do interst\u00edcio de efetivo exerc\u00edcio no padr\u00e3o atual, previsto na lei da respectiva carreira; e<\/li>\n<li>&#8211; atendimento ao crit\u00e9rio de m\u00e9rito.<\/li>\n<li>2\u00ba O crit\u00e9rio de m\u00e9rito consiste na obten\u00e7\u00e3o da pontua\u00e7\u00e3o m\u00ednima exigida pelo cumprimento dos requisitos previstos no Anexo I deste Decreto.<\/li>\n<li>3\u00ba Na primeira promo\u00e7\u00e3o funcional, caso n\u00e3o haja avalia\u00e7\u00e3o de desempenho, poder\u00e1, excepcionalmente, ser utilizada a m\u00e9dia das avalia\u00e7\u00f5es do per\u00edodo de est\u00e1gio probat\u00f3rio, inclu\u00edda no c\u00e1lculo a nota da Avalia\u00e7\u00e3o Especial que tenha autorizado a aquisi\u00e7\u00e3o da estabilidade.<\/li>\n<li>4\u00ba No caso previsto no \u00a73\u00ba a pontua\u00e7\u00e3o ser\u00e1 auferida de acordo com o conceito estabelecido no Anexo I, item &#8220;Avalia\u00e7\u00e3o de Desempenho ou Avalia\u00e7\u00e3o de Est\u00e1gio Probat\u00f3rio (M\u00e9dia Final)&#8221;, considerando a m\u00e9dia das notas obtidas, sendo estabelecida a seguinte correla\u00e7\u00e3o acerca da nota total:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li>de 0 a 40% = Insuficiente;<\/li>\n<li>de 40,01 a 60% = Regular; c) de 60,01 a 80% = Bom e,<\/li>\n<li>d) de 80,01 a 100% = Excelente.<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>5\u00ba Caso o resultado da m\u00e9dia da avalia\u00e7\u00e3o de desempenho seja Insuficiente, o servidor n\u00e3o ser\u00e1 promovido.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Art. 3\u00b0 O processo de promo\u00e7\u00e3o funcional ocorrer\u00e1 anualmente, no m\u00eas de julho, com efeitos financeiros retroativos \u00e0 data em que o servidor completou os requisitos de tempo e m\u00e9rito necess\u00e1rios \u00e0 sua concess\u00e3o.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1\u00ba No ato de aferi\u00e7\u00e3o do m\u00e9rito, para fins de pontua\u00e7\u00e3o, ser\u00e3o considerados os documentos citados na Tabela de Pontua\u00e7\u00e3o &#8211; Anexo I, referentes exclusivamente ao per\u00edodo da classe atual at\u00e9 a data em que o servidor completar o interst\u00edcio que dar\u00e1 causa \u00e0 promo\u00e7\u00e3o funcional, exceto quando o servidor concorrer \u00e0 promo\u00e7\u00e3o pela primeira vez.<\/li>\n<li>2\u00ba Excetua-se do disposto no par\u00e1grafo anterior os concernentes \u00e0 conclus\u00e3o de cursos de p\u00f3s- gradua\u00e7\u00e3o, que podem ser apresentados a qualquer tempo.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Art. 4\u00ba Os cursos de aperfei\u00e7oamento ou capacita\u00e7\u00e3o, presenciais ou \u00e0 dist\u00e2ncia, ser\u00e3o considerados quando relacionados ao desenvolvimento profissional, aquisi\u00e7\u00e3o ou amplia\u00e7\u00e3o dos conhecimentos, habilidades e atitudes vinculadas \u00e0s atribui\u00e7\u00f5es do cargo ocupado ou com a unidade de lota\u00e7\u00e3o e exerc\u00edcio do servidor.<\/p>\n<p style=\"text-align: justify;\">Art. 5\u00ba Os diplomas de gradua\u00e7\u00e3o, especializa\u00e7\u00e3o, mestrado e doutorado somente ser\u00e3o aceitos se expedidos por institui\u00e7\u00f5es credenciadas pelo Minist\u00e9rio da Educa\u00e7\u00e3o, conforme legisla\u00e7\u00e3o espec\u00edfica.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1\u00ba Os diplomas expedidos por institui\u00e7\u00f5es estrangeiras de ensino ser\u00e3o aceitos desde que devidamente revalidados ou reconhecidos em territ\u00f3rio nacional, na forma da legisla\u00e7\u00e3o espec\u00edfica.<\/li>\n<li>2\u00ba Nos cursos de especializa\u00e7\u00e3o, mestrado e doutorado, presenciais ou \u00e0 dist\u00e2ncia, ser\u00e3o considerados aqueles que guardarem pertin\u00eancia com as atribui\u00e7\u00f5es do cargo e especialidade ou da unidade de lota\u00e7\u00e3o e exerc\u00edcio.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>3\u00ba Os cursos de gradua\u00e7\u00e3o, especializa\u00e7\u00e3o, mestrado e doutorado, presenciais ou \u00e0 dist\u00e2ncia, utilizados para a percep\u00e7\u00e3o da Gratifica\u00e7\u00e3o por Habilita\u00e7\u00e3o ou Gratifica\u00e7\u00e3o de Titula\u00e7\u00e3o, poder\u00e3o ser utilizados para fins de promo\u00e7\u00e3o funcional.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Art. 6\u00ba A pontua\u00e7\u00e3o excedente do limite estabelecido no Anexo I, relativa aos cursos previstos nos artigos 4\u00ba e 5\u00ba, ser\u00e1 utilizada na apura\u00e7\u00e3o de m\u00e9rito subsequente e devidamente registrada no Curr\u00edculo Padr\u00e3o, constante no Anexo III, bem como nos assentamentos funcionais do servidor.<\/p>\n<p style=\"text-align: justify;\">Art. 7\u00ba A promo\u00e7\u00e3o funcional dos servidores da Carreira de Auditoria Tribut\u00e1ria, observar\u00e1 o interst\u00edcio m\u00ednimo de 18 meses e m\u00e1ximo de 24 meses no \u00faltimo padr\u00e3o da classe, estabelecido pela <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=4717&amp;amp;txtAno=2011&amp;amp;txtTipo=5&amp;amp;txtParte\">Lei n\u00ba 4.717<\/a>, de 27 de dezembro de 2011.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1\u00ba A promo\u00e7\u00e3o dos servidores abrangidos pelo caput, ser\u00e1 reconhecida no m\u00eas de julho, com vig\u00eancia retroativa \u00e0 data em que o servidor completou interst\u00edcio m\u00ednimo de 18 meses de que trata o art. 8\u00ba, \u00a73\u00ba, da <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=4717&amp;amp;txtAno=2011&amp;amp;txtTipo=5&amp;amp;txtParte\">Lei n\u00ba 4.717\/2011<\/a>, observado o resultado da avalia\u00e7\u00e3o institu\u00edda para este fim e os demais requisitos fixados neste Decreto.<\/li>\n<li>2\u00ba Nos casos em que, no m\u00eas de julho, o servidor completar interst\u00edcio superior a 24 meses previstos no art. 8\u00ba, \u00a73\u00ba, da <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=4717&amp;amp;txtAno=2011&amp;amp;txtTipo=5&amp;amp;txtParte\">Lei n\u00ba 4.717\/2011<\/a> a promo\u00e7\u00e3o ser\u00e1 reconhecida, excepcionalmente, em janeiro, com vig\u00eancia retroativa \u00e0 data em que completou o interst\u00edcio m\u00ednimo de 18 meses.<\/li>\n<li>3\u00ba Uma vez completado o interst\u00edcio m\u00ednimo para promo\u00e7\u00e3o, estabelecida pela <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=4717&amp;amp;txtAno=2011&amp;amp;txtTipo=5&amp;amp;txtParte\">Lei n\u00ba 4.717\/2011<\/a>, ter\u00e1 in\u00edcio a contagem do interst\u00edcio para a concess\u00e3o de nova progress\u00e3o, sendo vedada a contagem do interst\u00edcio de maneira concomitante para fins de promo\u00e7\u00e3o e progress\u00e3o funcional.<\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\">DA AFERI\u00c7\u00c3O DE M\u00c9RITO<\/h4>\n<p style=\"text-align: justify;\">Art. 8\u00ba Para ser promovido, quando da apura\u00e7\u00e3o do m\u00e9rito, o servidor ter\u00e1 que obter, no m\u00ednimo, a pontua\u00e7\u00e3o a seguir:<\/p>\n<ul style=\"text-align: justify;\">\n<li>&#8211; para cargos cuja exig\u00eancia de escolaridade corresponde ao n\u00edvel m\u00e9dio:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li>da 3\u00aa para a 2\u00aa Classe &#8211; 70 pontos;<\/li>\n<li>da 2\u00aa para a 1\u00aa Classe &#8211; 75 pontos; e<\/li>\n<li>da 1\u00aa para a Classe Especial &#8211; 80<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>&#8211; para cargos cuja exig\u00eancia de escolaridade corresponde ao n\u00edvel superior:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li>da 3\u00aa para a 2\u00aa Classe &#8211; 80 pontos;<\/li>\n<li>da 2\u00aa para a 1\u00aa Classe &#8211; 85 pontos; e<\/li>\n<li>da 1\u00aa para a Classe Especial &#8211; 90<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>1\u00ba A pontua\u00e7\u00e3o ser\u00e1 aplicada observando-se o cumprimento dos quesitos relativos a cada fator de merecimento a que se refere o Anexo II deste Decreto.<\/li>\n<li>2\u00ba Para fins de apura\u00e7\u00e3o do m\u00e9rito, o servidor concorrente \u00e0 promo\u00e7\u00e3o dever\u00e1 proceder ao preenchimento do &#8220;Curr\u00edculo Padr\u00e3o&#8221; constante do Anexo III deste Decreto, no qual dever\u00e3o ser anexados os comprovantes relativos aos dados informados.<\/li>\n<li>3\u00ba O formul\u00e1rio do &#8220;Curr\u00edculo Padr\u00e3o&#8221; ser\u00e1 disponibilizado ao servidor pela comiss\u00e3o de que trata o art. 9\u00ba, durante o m\u00eas de fevereiro, devendo ser preenchido por ele e restitu\u00eddo \u00e0quela at\u00e9 o \u00faltimo dia \u00fatil do m\u00eas.<\/li>\n<li>4\u00ba No caso de aus\u00eancia da pontua\u00e7\u00e3o m\u00ednima necess\u00e1ria para cumprimento do requisito de m\u00e9rito, o servidor n\u00e3o ser\u00e1 promovido, devendo cumprir novo interst\u00edcio para participar novamente do processo de promo\u00e7\u00e3o funcional.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Art. 9\u00ba A apura\u00e7\u00e3o do m\u00e9rito para efeito da promo\u00e7\u00e3o ser\u00e1 feita por comiss\u00e3o de aferi\u00e7\u00e3o de m\u00e9rito.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1\u00ba A comiss\u00e3o ser\u00e1 composta por at\u00e9 cinco membros, devendo ter maioria de servidores efetivos.<\/li>\n<li>2\u00ba A comiss\u00e3o dever\u00e1 ser institu\u00edda no \u00e2mbito de cada \u00f3rg\u00e3o ou entidade por ato do respectivo titular, ao qual ficar\u00e1 subordinada.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Art. 10. O resultado da apura\u00e7\u00e3o do m\u00e9rito ser\u00e1 publicado anualmente no Di\u00e1rio Oficial do Distrito Federal, at\u00e9 o dia 30 de abril.<\/p>\n<p style=\"text-align: justify;\">Art. 11. Do resultado da apura\u00e7\u00e3o do m\u00e9rito caber\u00e1 recurso, no prazo de 30 dias, contados a partir da publica\u00e7\u00e3o do resultado.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1\u00b0 O recurso ser\u00e1 apresentado ao presidente da comiss\u00e3o, acompanhado das provas consideradas pertinentes.<\/li>\n<li>2\u00ba Da decis\u00e3o proferida pela comiss\u00e3o cabe recurso de reconsidera\u00e7\u00e3o ao titular do \u00f3rg\u00e3o ou entidade, no prazo de 5 dias \u00fateis.<\/li>\n<li>3\u00b0 O titular do \u00f3rg\u00e3o ou entidade dispor\u00e1 de outros 5 dias \u00fateis para proferir decis\u00e3o final.<\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\">DO INTERST\u00cdCIO<\/h4>\n<p style=\"text-align: justify;\">Art. 12. O interst\u00edcio para os efeitos deste Decreto ser\u00e1 computado em per\u00edodos corridos, sendo suspenso nos casos de afastamento previstos nos arts. 133; 134, \u00a74\u00ba; 137, inciso I, \u00a71\u00ba; 144; 159, inciso II e 162, \u00a71\u00ba, inciso II, todos da <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=840&amp;amp;txtAno=2011&amp;amp;txtTipo=4&amp;amp;txtParte\">Lei Complementar n\u00b0 840<\/a>, de 23 de dezembro de 2011.<\/p>\n<p style=\"text-align: justify;\">Art. 13. As hip\u00f3teses previstas no art.164 da <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=840&amp;amp;txtAno=2011&amp;amp;txtTipo=4&amp;amp;txtParte\">Lei Complementar n\u00ba 840<\/a>, de 23 de dezembro de 2011, n\u00e3o s\u00e3o computadas no tempo de servi\u00e7o, salvo disposi\u00e7\u00e3o legal em contr\u00e1rio.<\/p>\n<p style=\"text-align: justify;\">Par\u00e1grafo \u00fanico. Quando o servidor estiver cumprindo a penalidade de suspens\u00e3o disciplinar, e ficar apurada a improced\u00eancia da penalidade aplicada, ser\u00e1 retomada a contagem do interst\u00edcio a partir da data de seu afastamento, sem desprezar a parcela do interst\u00edcio j\u00e1 cumprido.<\/p>\n<p style=\"text-align: justify;\">Art. 14. Consideram-se per\u00edodos corridos para os efeitos deste decreto aqueles contados de data a data.<\/p>\n<p style=\"text-align: justify;\">Art. 15. Na hip\u00f3tese de suspens\u00e3o do interst\u00edcio a contagem ser\u00e1 retomada a partir do dia da reassun\u00e7\u00e3o do exerc\u00edcio, sem desprezar a parcela do interst\u00edcio j\u00e1 cumprido.<\/p>\n<p style=\"text-align: justify;\">Art. 16. Ser\u00e3o considerados como efetivo exerc\u00edcio, para efeitos deste Decreto, os afastamentos previstos no art. 165, da <a href=\"http:\/\/www.fazenda.df.gov.br\/aplicacoes\/legislacao\/legislacao\/TelaSaidaDocumento.cfm?txtNumero=840&amp;amp;txtAno=2011&amp;amp;txtTipo=4&amp;amp;txtParte\">Lei Complementar n\u00ba 840<\/a>, de 23 de dezembro de 2011.<\/p>\n<h4 style=\"text-align: justify;\">DAS DISPOSI\u00c7\u00d5ES FINAIS<\/h4>\n<p style=\"text-align: justify;\">Art. 17. A publica\u00e7\u00e3o da promo\u00e7\u00e3o funcional ser\u00e1 de responsabilidade da unidade de gest\u00e3o de pessoas do \u00f3rg\u00e3o ou entidade de lota\u00e7\u00e3o do servidor, mediante ato do titular, no m\u00eas de julho de cada ano, observado o cronograma da folha de pagamento.<\/p>\n<p style=\"text-align: justify;\">Art. 18. Ser\u00e1 concedida para todos os efeitos legais a promo\u00e7\u00e3o a que fizer jus o servidor que vier a se aposentar ou a falecer antes da publica\u00e7\u00e3o do respectivo ato, desde que cumprido todos os requisitos necess\u00e1rios.<\/p>\n<p style=\"text-align: justify;\">Art. 19. Excepcionalmente, no ano em curso, os servidores que j\u00e1 tiverem cumprido o requisito de tempo e tiverem sua aferi\u00e7\u00e3o de m\u00e9rito alterada pelas disposi\u00e7\u00f5es deste Decreto, poder\u00e3o apresentar comprovante de participa\u00e7\u00e3o em eventos de capacita\u00e7\u00e3o realizados at\u00e9 60 dias ap\u00f3s a publica\u00e7\u00e3o deste Decreto.<\/p>\n<p style=\"text-align: justify;\">Art. 20. Este Decreto entra em vigor na data de sua publica\u00e7\u00e3o. Art. 21. Revogam-se as disposi\u00e7\u00f5es em contr\u00e1rio.<\/p>\n<p style=\"text-align: justify;\">Bras\u00edlia, 14 de novembro de 2016 128\u00ba da Rep\u00fablica e 57\u00ba de Bras\u00edlia<\/p>\n<h6
